This writ petition is filed for issuance of writ of Mandamus, to direct the respondents 1 and 2 to appoint the petitioner for the post of sales women in any one of the Fair Price Shop in Tuticorin District admittedly out of 2 vacancies available as on date as per the communication of the respondents under the special category of 'heirs Freedom Fighter Quota' based on the notification of the respondents.

2.The learned Special Government Pleader appearing for the respondents 2/5

submitted that already the selection process is over and they have appointed 71 candidates. 64 candidates have joined duty including the backlog vacancies. 3.The claim of the petitioner is to consider the petitioner under priority category. In the counter affidavit, the respondents have not stated whether the petitioner is entitled to be considered under priority category or not. 4.Therefore, this Court is remitting back the case to the respondents to consider the claim of the petitioner and pass appropriate speaking orders within a period of 8 weeks from the date of receipt of a copy of this order. It is made clear that this Court is not expressing any opinion on the merits of the case. 5.With the above said observation, the writ petition is disposed of. No costs.
