BEFORE THE MADURAI BENCH OF MADRAS HIGH COURT ( Criminal Jurisdiction ) Date : 22/08/2024 PRESENT The Hon`ble Mr.Justice D.BHARATHA CHAKRAVARTHY Sundarrajan, ... Petitioner/Accused No.3 Vs The Inspector of Police, District Crime Branch Police Station, Theni District.

Crime No.34/2023..

... Respondent/Complainant For Petitioner : Mr.D.Ashokkumar, Advocate.

For Respondent : Mr.R.M.Anbunithi, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec. 482 BNSS PRAYER :- For Anticipatory Bail in Crime No.34/2023 on the file of the Respondent Police. ORDER : The Court made the following order :- The petitioner/A3, who apprehends arrest at the hands of the respondent police 1/3

for the offences punishable under Sections 417, 420 and 120(B) of IPC, in Crime No.34 of 2023 on the file of the respondent police, seeks anticipatory bail. 2.The case of the prosecution is that the petitioner and the other accused have received the amount of Rs.40,00,000/- from the from the defacto complainant and his relatives on the pretext of getting appointment in the judiciary. Hence, the complaint.

3.Heard. Perused the materials available on record including the First Information Report.

4.In this case, the greedy victims illegally thought that they will get appointment in the High Court by approaching unscrupulous elements.

5. The allegation against the petitioner is that the petitioner being accused No.3 along with the accused No.2 went to the house of the de facto complainant where all 8 persons, who are willing to give money were assembled and thereafter, money was given to A1. The petitioner is aged about 67 years and being an elderly person, he thinks that the job can be arranged in the high court. When such serious things 2/3

are being done in a casual manner by using the name of High Court, even though A2 was granted anticipatory bail, I am not inclined to grant anticipatory bail to the petitioner.

6. Accordingly, this Criminal Original Petition is dismissed. sd/- 22/08/2024 / TRUE COPY / /09/2024 Sub-Assistant Registrar ( C.S. I / II / III / IV ) Madurai Bench of Madras High Court, Madurai - 625 023.
