PRAYER :- For Bail in Crime no.45 of 2022 on the file of the Respondent Police. ORDER : The Court made the following order :- The petitioner/Accused No.17 herein, who was arrested on 02.06.2023 for the alleged offence under Sections 342, 376, 506(i), 34 of IPC r/w 4, 6, 5(1), 11(V) & 17 of the Protection of Children From Sexual Offences Act, 2012 r/w 3(2)(a) r/w 4(1), 5(1) of Immoral Traffic Act and Section 77 of the Juvenile Justice Act, 2015, in Crime No.45 of 2022, on the file of the respondent police, seeks bail. 1/3

2.The earlier bail application filed by the petitioner in Crl.O.P.(MD).No.13358 of 2023 was dismissed by this Court on 25.07.2023, considering the seriousness of the offence. This is the second bail application filed by the petitioner. 3.The learned Additional Public Prosecutor today would submit that there is no history sheet was opened against the petitioner. Apart from that it is also brought to the notice of this Court that A1, A2, A7, A11, A12 and A13 are detained under Act

14. A20 died in prison. Other accused persons viz., A3, A4, A5, A8, A9 and A10 have been released on bail. A6 has been released on anticipatory bail. He would further submit that final report in this case has been filed, but not taken cognizance so far. He would further submit that the petitioner is involved in some previous cases. 4.Even though the petitioner is having previous cases, in view of the above said development, considering the period of incarceration, some of the co-accused has been released on bail and the fact that the final report has been filed before the concerned Court, this Court is inclined to grant bail to the petitioner with stringent conditions.

5.Accordingly, this Criminal Original Petition is allowed and the petitioner is ordered to be released on bail, on executing a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Sessions Judge, Additional Sessions Court, Fast Track 2/3
