For Petitioner :Mr.P.Chandrasekar For Respondents :Mr.B.Thanga Aravindh Government Advocate (crl.side) O RDER This Criminal Original Petition is filed under Section 482 of the Code of Criminal Procedure seeking transfer of investigation in Crime No.211 of 2023 from the file of the respondent No.4 police to the file of the respondent No.2 police.
2.According to the learned counsel for the petitioner, on a complaint given by the petitioner, a case has been registered in Crime No.211 of 2023 dated 13.05.2023 for the offences punishable under Sections 341, 294(b), 323, 379, 354, 427 and 506(i) IPC. It is submitted that the accused No.1 in the said FIR is a police constable working in the respondent No.4 police station. It is submitted further that even though sufficient evidence has been produced against the accused, the respondent No.4 police have not been taking any action. 3.The learned Government Advocate (Crl.side) has submitted that no material is provided to the police and in case sufficient evidence is produced, 2/5
certainly action will be initiated against the accused. 4.In view of the submissions made by the learned counsel on either side and considering the fact that the accused No.1 in Crime No.211 of 2023 is a police constable working in the respondent No.4 police station, the respondent No.3 are directed to supervise the investigation in Crime No.211 of 2023 personally and the petitioner is directed to submit the entire evidence in respect of the alleged offence to the concerned police.
