Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus, to call for the records relating to order passed by the fourth respondent by her proceedings dated 14.07.2014 in Na.Ka.No.362/AA2/13 and consequently direct the respondents 1 to 4 to revise the scale of pay of the petitioner in the Special Grade Pay Scale of Primary School Head Master since 24.06.1997 and accordingly, pay the arrears of salary and re-fix the amount of pension paid to the petitioner and grant other consequential benefits in accordance with G.O.Ms.No.207, School Education Department (G2), dated 30.09.2008. ORDER

In view of the Full Bench Judgment, the case of the writ petitioner is to be considered. The writ petition was filed before the crucial date fixed by the Full Bench of this Court i.e. on 09.12.2016. The writ petition was filed by the petitioner in the year 2014, seeking benefit of the Government Order issued in G.O.Ms.No.216, Finance (Pay Cell) Department, dated 22.03.1993 and other connected orders. This being the factum, the case of the writ petitioner is to be reconsidered for extension of the benefit of the Government order in accordance with the directions issued by the Full Bench of this Court in the case of Government of Tamil Nadu Vs. G.Easwaran and Others reported in (2017) 2 MLJ 257. 2.

Accordingly, the writ petitioner is permitted to submit the facts and details to the respondents and the respondents are directed to consider the said representation with reference to the Judgment of the Full Court cited supra and take a decision and pass orders within a period of twelve weeks from the date of receipt of a copy of the representation from the writ petitioner. 3.Accordingly, the writ petition stands disposed of. No costs.
