Mr.A.Albert James, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 482 of BNSS PRAYER :- For Anticipatory Bail in Crime No.36 of 204 on the file of the respondent police.

ORDER : The Court made the following order :- The petitioners/Accused, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 379 and 511 I.P.C and Section 21(4) of Tamil Nadu Mines and Minerals (Development and Regulations) Act, 1957, in Cr.No. 36 of 2024, seek anticipatory bail. 1/3

The case of the prosecution is that when the defacto complainant, who is working as Special Revenue Inspector of Mines and Minerals Department, had conducted a surprise visit, it was found two tractors with compressor involved in a stone crushing and on seeing the defacto complainant, the petitioners had ran away from the scene of occurrence. Hence, the complaint.

3. Heard the learned counsel on either side and perused the material records of the case.

4.Considering the overall facts and circumstances of the case and also considering the fact that the petitioners are said to have involved in a setting up of crusher unit, without even license, even though the learned counsel for the petitioner summit that they are only labourers, the said fact was disputed on behalf of the prosecution and when they are involving in such a daring act, this is not a case for grant of anticipatory bail to the petitioners.

5. Accordingly, this Petition is dismissed.
