PRAYER:- For Anticipatory Bail in Crime No.06 of 2023 on the file of the Respondent Police.

ORDER: The Court made the following order:-

The petitioner, who is arrayed as an accused apprehends arrest at the hands of the respondent police for the offences punishable under sections 120(b), 406, 420, 465 and 468 IPC, in Crime No.06 of 2023 on the file of the respondent police, seeks anticipatory bail. 2.The case of the prosecution is that the de-facto complainant lodged a complaint stating that one Ayyappan was introduced to him through Prabhu Kannan. Prabhu Kannan informed him that he can arrange a job for him through the above said Ayyappan. They were also informed that Vishu son of the above said Ayyappan and his son-inlaw Arun Kumar are having good conduct with higher officials. He also shown his appointment order. They also assured to arrange the job in TNEB. At the invitation, he went to Ayyappan's house. At that time, his wife namely Mala and son Vishu were available.

At that time, Vishu informed him that through Arunkumar arrangement has been made to secure job. Arunkumar also contacted through phone. It is stated that Rs.20,00,000/- is required for arranging job. He was taken to Arunkumar's house and at that time, he found 10 persons were available stating that they came for writing written test.

the written test. Later, Ayyappan informed that appointment is also made ready and money must also be transferred to his account for handing over the appointment order. So, he transferred Rs.9,00,000/-. After some-time, Rs.5,00,000/- was paid in cash to the above said Mala namely the wife of Ayyappan. Vishu received the original documents. But they delayed the appointment order. It created doubt and when he went to the Ayyappan's house, it was found locked, so also the Arukumar's house. He tried to contact him through phone, but failed. Later, he came to know that he was cheated. On the basis of the above said occurrence, a case was registered as stated above.

3.During the course of investigation, the involvement of this petitioner also came to light. 4.Seeking anticipatory bail, this petition has been filed by the petitioner.

5.The learned Senior counsel appearing for the petitioner would submit that even as per the allegations made in the FIR, no implication of this petitioner has

been mentioned and only five persons name are mentioned. This petitioner name is not found place.

6.The learned Additional Public Prosecutor would submit that during the court of the investigation, the involvement of the petitioner came to light. The petitioner is involved in several previous cases of similar nature in Crime Nos.34 of 2019, 1293 of 2016, 131 of 2021 and 104 of 2018 and 7 of 2018. He has also produced the list. Most of the cases are pending investigation and the offences alleged are similar in nature.

7.It is further submitted by the learned Additional Public Prosecutor that only this petitioner alleged to have prepared the above said fake order, that was also sent by A1 through whatsapp to the de-facto complainant. 8.Only a thorough investigation will bring the truth to light, for which, the custodial interrogation is required. This sort of offence cannot be taken lightly, rather it must be viewed seriously. All the bail petitions and the anticipatory bail petitions of the co-

accused were also dismissed. So, I find no reason to entertain this petition. The petitioner must surrender before the respondent police.

9.In the result, this criminal original petition is dismissed.
