ORDER : The Court made the following order :- The petitioner/Accused No.3, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 406, 420, 465, 468, 471 and 407 of IPC, in Cr.No.149 of 2022, seeks anticipatory bail.

2.The case of the prosecution is that the petitioner along with other accused by giving false promise to construct a house, received a sum of Rs.33,24,962/- from the de-facto complainant. Hence, the complaint.

3.On the side of the petitioner, it is stated that the de-facto complainant entered into an agreement for construction with A1, who received a sum of Rs.33,24,962/-. A3 is the employee of A1 and he https://www.mhc.tn.gov.in/judis 1/2

No.16423 of 2022 has not received any money from the de-facto complainant and prayed the petitioner to be released on anticipatory bail. 4.On the side of the prosecution, it is stated that the defacto complainant gave a sum of Rs.33,24,962/- to A1 for constructing the house. A1 had spent a sum of Rs.18,94,000/- only to construct the house. A3 is the supervisor and all the accused cheated the de-facto complainant and created a forged bills and received huge amount from the de-facto complainant. It is further stated that the investigation is pending and prayed the petition to be dismissed.

5.Considering the above facts and circumstances of the case and also considering the seriousness and gravity of the offence alleged and also considering the fact that investigation is still pending, this Court is not inclined to grant anticipatory bail to the petitioner.
