ORDER

The Petitioner has filed the above Writ Petition to issue a Writ of Mandamus, directing the Respondents to give permission to conduct a cultural program (Adal Padal) scheduled to be held on 16.09.2022 and other programmes scheduled to be held from 09.09.2022 to 16.09.2022 on the eve of Arulmigu Sri Kadampa Muneeswarar Sakkammal Temple festival situated in Pullangudi, 2/6

2.Heard the learned Counsel for the Petitioner, learned Additional Government Pleader for the 1st respondent, who takes notice for the 1st respondent and the learned Additional Public Prosecutor appearing for the Respondents 2 to 4, who takes notice for the Respondents 2 to 4. By consent, the Writ Petition itself is taken up for final disposal.

3.When the case came up for hearing yesterday (14.09.2022), the learned Additional Public Prosecutor for the Respondents 2 to 4 opposed the Petition stating that this Petition had been filed by the Petitioner in his individual capacity. There is no mention about the Office Bearer of the Organizing Committee for the temple festival. Therefore, this Court had directed the learned Counsel for the Petitioner to file better affidavit by the persons, who are in the responsibility of the Organizing Committee seeking permission to conduct the Cultural Programme (Aadal Padal) on the eve of Arulmigu Sri Kadampa Muneeswarar Sakkammal Temple festival situated in Pullangudi, Ramanathapuram District. 3/6

4.Today (15.09.2022), when the case came up for hearing, the learned Additional Public Prosecutor vehemently objects stating that from 10.09.2022 to 31.10.2022, the entire Ramanathapuram District is under 144 Cr.P.C. 5.In view of the submission made by the learned Additional Public Prosecutor, the Writ Petition is disposed of with a direction to the Respondents 1 and 2 to consider the petitioner's representation dated 07.09.2022 and pass appropriate orders today itself, in the light of the developments of the Ramanathapuram District. No costs.
