PRAYER :- For Anticipatory Bail in Crime No.302 of 2025 on the file of the Respondent Police. ORDER : The Court made the following order :- The petitioner/Sole Accused, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 296(b), 126(2), 115(2), 118(1) and 351(3) of BNS 2023, in Crime No.302 of 2025 on the file of the respondent police, seeks anticipatory bail.

The case of the prosecution is that there was previous enmity between the petitioner and the defacto complainan, due to which, on 10.07.2025, at about 09.30 pm, near Athikaram Bus Stop, the petitioner abused the defacto complainant in filthy language and attacked him with iron rod and caused injuries. Hence, the complaint.
3.The learned counsel for the petitioner submitted that the petitioner is innocent person and he has not committed any offence as alleged by the prosecution. He further submitted that the present case is a counter case arising out of Crime No.301 of 2025, in which, the defacto complainant is the accused. He further submitted that the petitioner is ready and willing to abide any conditions that may be imposed by this Court.
4.The learned Government Advocate (Criminal Side) submitted that there was previous enmity between the petitioner and the defacto complainan, due to which, on 10.07.2025, at about 09.30 pm, near Athikaram Bus Stop, the petitioner abused the defacto complainant in filthy language and attacked him with iron rod and caused injuries. He further submitted that the injured is taking treatment as inpatient at Government Hospital, Manapparai and the investigation is at preliminary stage.
5. Considering the facts and circumstances of the case and taking into account of the fact that the injured is still taking treatment as inpatient in hospital and the 2/3
investigation is at initial stage, this Court is not inclined to grant anticipatory bail to the petitioner at this stage.
