PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus directing the respondents herein to grant forthwith re-employment to the petitioner as Associate Professor and Head in the Department of Botany in the 3rd respondent-college from 01.08.2025 to 31.05.2026 with salary and other attendant benefits. 1/4

ORDER
The present Writ Petition has been filed by an Associate Professor of the third respondent College seeking a mandamus directing the respondents to grant re-employment forthwith.
2.A perusal of the order reveals that the petitioner has attained superannuation on 31.07.2025. However, the third respondent College Management has not forwarded the proposal to the first respondent for passing appropriate order for re-employment.
3.When the matter came up for admission on 29.07.2025, it was adjourned today(30.07.2025) to get the views of the third respondent College. 4.The learned Counsel appearing for the third respondent College has submitted that the third respondent College has forwarded the proposals on 2/4
30.07.2025, to the second respondent and the second respondent is likely to forward the same to the first respondent for passing appropriate orders. 5.Considering the above said facts, the second respondent is directed to forward the proposals submitted by the third respondent College to the first respondent on or before 10.08.2025. The first respondent is directed to pass orders on merits and in accordance with law on or before 30.08.2025. 6.In case, if the first respondent decides to confer re-employment upon the petitioner, the Management would be liable for payment of salary for the non-employment period.
7.With the above said observations, this Writ Petition stands disposed of. No costs. Consequently, connected Writ Miscellaneous Petition is also closed. 30.07.2025 NCC : Yes/No Index : Yes/No Internet: Yes/No RJR 3/4
