Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the first Respondent to issue Passport bearing its Application Number TR1065061098523 based on the petitioner's explanation/representation dated 15.07.2025 within a time limit stipulated by this Court. ORDER

This writ petition has been for a writ of Mandamus to direct the first respondent to issue passport bearing its Application Number TR1065061098523 based on the petitioner's explanation/representation dated 15.07.2025.

2. It is noticed that an FIR has been registered against the petitioner in Crime No.507 of 2021 dated 10.06.2021 for offences under Sections 147, 148, 294(b), 324, 336, 506(2) of the IPC.

3. The learned Government Advocate for the second respondent submits that the case is still under investigation and no charge sheet has been filed till date.

4. Considering the same, there can be no impediment in directing the first respondent to procees the petitioner's passport application for issuance of passport.

Under these circumstances, the first respondent is directed to process the petitioner's passport application and issue passport to the petitioner within a period of 6 weeks from the date of receipt of a copy of this order. In case charge sheet is filed, the petitioner shall surrender the passport before the concerned court and thereafter retrieve the same as and when the petitioner proposes to travel abroad by filing appropriate application.

6. It is made clear that in case the petitioner fails to surrender the passport before the concerned Court, the first respondent is at liberty to cancel the passport after due intimation to the second respondent.
