PRAYER : Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Certiorarified Mandamus to call for the records of the Impugned refusal check slip in RFL/Paramakudi/56/2025 dated 14.07.2025 issued by the 2nd respondent and quash the same as illegal and arbitrary, and consequentially to direct the 2nd respondent to receive and register the mortgage deed dated 04.06.2025 executed by the petitioner in favour of Mr.Nagarajan, in respect of the lands in Survey Nos. 275 and 280, Keelaaikudi Village, Ilayangudi Taluk, Sivagangai District within a time frame as may be fixed by this Court. ORDER

The present Writ Petition has been filed for the issuance of a Writ of Certiorarified Mandamus to quash the Impugned refusal check slip dated 14.07.2025 issued by the 2nd respondent and consequentially to direct the 2nd respondent to receive and register the mortgage deed dated 04.06.2025 executed by the petitioner within a time frame as may be fixed by this Court.

2. One Malaikannu, as intervenor claiming himself to be a owner of the property and he has filed an objection. With regard to the disputed property, a suit in O.S.No.28 of 2024 is pending on the file of the District Munsif cum Judicial Magistrate, Ilayangudi. However, there is no interim injunction in the said suit.

3. Considering the facts of the case, the impugned refusal check slip dated 14.07.2025 issued by the 2nd respondent is hereby quashed and direct the 2nd respondent to receive and register the mortgage deed dated 04.06.2025, within a period of four weeks from the date of receipt of a copy of the order. 2/4

4. With the above observations, this Writ Petition is disposed of. There shall be no order as to costs.
