The Petitioner herein seeks a direction to the respondents1 and 2 to survey the Petitioner's property in S.No.1202/3A, situated at Ethirkottai Revenue Village, Vembakottai Taluk, Virudhunagar District by considering the Petitioner's application, dated 14.7.2025.
2.Mr.M.Gangatharan, learned Government Advocate takes notice for the respondents 1 and 2 and Mr.M.Vaikkam Karunanithi, learned Government Advocate(Crl.Side) takes notice for the third respodnent. By consent of both parties, the Writ Petition is taken up for final disposal at the admission stage itself. 2/6
3.According to the Petitioner, the subject property originally belong to the Petitioner's father-in-law Chelliah Thevar. The Petitioner's husband as well as father-in-law Chelliah Thevar are no more. Thus the Petitioner claims share in the subject property. He submitted an application on 14.07.2025 in application No. 2025/0123/26/009379 seeking survey of the subject property. The same has not been considered so far. Hence the Petitioner has come before this Court with present Writ Petition for the relief stated supra.
4.Mr.M.Gangatharan, learned Government Advocate, who takes notice for the respondents 1 and 2 would submit that the online application submitted by the Petitioner will be considered on its own merits within the time stipulated by this Court. 5.In view of the same, without expressing any opinion on the merits of the matter, the respondents 1 and 2 are directed to consider the online application of the Petitioner, dated 14.7.2025 and pass final orders on its own merits after issuing notice to the legal heirs of Chelliah Thevar(Nallu Thevar), Petitioner's husband Paldhevar, Adjacent land owners and other interested parties, if any, within a period of 12 weeks from the date of a copy of this 3/6
order.
6.With the above directions, the Writ Petition stands disposed of. No costs.
