ORDER
The Criminal Original Petition is filed to quash the proceedings in C.C.No.2033 of 2022 pending on the file of the learned Judicial Magistrate No.I, Tirunelveli District, as against the petitioners.
2. The case of the prosecution is that the 1st accused and the defacto complainant were married on 20.12.2022. It is alleged that the 1st petitioner, who is the father of the 1st accused, misbehaved with the de2/7
facto complainant. When she informed the 1st accused about this, he asked her to be amenable to his father as well as to his brother/A4. It is further alleged that all the accused persons harassed the de-facto complainant, thereby causing her mental torture, and also threatened her with dire consequences. Hence, the present case.
3. When the matter was taken up for hearing today (11.08.2025), the learned counsel appearing on either side was present, and the petitioners as well as the 2nd respondent were also present in person before this Court.

The learned counsel appearing for the petitioners submitted that the 2nd respondent lodged a complaint before the 1st respondent police, and on that basis, an FIR was registered against the petitioners in Crime No.17 of 2022 dated 01.08.2022 for the offences under Sections 498(A), 354, 294(b), and 506(1) of IPC. Subsequently, a final report was filed under Sections 498(A), 354, 294(b), 406, and 506(1) of IPC, and the same was taken on file as C.C.No.2033 of 2022 dated 16.08.2022, pending on the file of the learned Judicial Magistrate No.I, Tirunelveli. 3/7
5. The learned counsel for the 2nd respondent submitted that the 2nd respondent/de-facto complainant is now married to another person and is living peacefully, and that she does not wish to pursue the case any further, as she wants to move on with her life.
6. Both parties were identified by their respective counsel, and their identities were also verified by this Court. A Joint Compromise Memo has been filed by the learned counsel appearing on either side, which has been signed by both parties, and the relevant portions thereof are extracted hereunder:
"1. The petitioners and the 2nd respondent/defacto complainant would jointly submit that the 2nd respondent gave a complaint against the petitioners before the 1st respondent police and the same was registered in Crime No. 17 of 2022 dated 01.08.2022 against the above said petitioners for an offences punishable U/s. 498(A), 354, 294(b) and 506(i) IPC. Thereafter, the 1st respondent filed the Charge sheet dated 16.08.2022 in C.C.No.2033 of 2022, U/s.498(A), 354, 294(b), 406 and 506(i) IPC, on the file of the Learned Judicial Magistrate Court No.I, 4/7
Tirunelveli District.
2. The above matter has been amicably settled out of Court between the petitioners and the 2nd respondent. The petitioners submit that in view of the Compromise between the petitioners and the 2nd respondent for a peaceful future, this Honourable Court may be pleased to permit them to compound the offences in the interest of justice, though some of the offences are not compoundable.
3. The second respondent herein would submit that she is not interested in conducting the further proceedings in Crime No.17 of 2022 and willing to quash the Charge sheet dated 16.08.2022 in C.C.No.2033 of 2022, U/s.498(A), 354, 294(b), 406 and 506(i) IPC, on the file of the Learned Judicial Magistrate Court No.I, Tirunelveli District."
7. The above terms of the Joint Compromise Memo were read over and explained to both parties in the presence of their respective counsel, and both parties submitted that the same were correct. Accordingly, the said Joint Compromise Memo is recorded.

Considering the overall facts and circumstances of the case, and taking note of the fact that both sides have compromised the matter, and that the de-facto complainant is now married to another person and is living peacefully, and that she does not wish to pursue the case any further as she intends to move on with her life, I am inclined to exercise the inherent powers of this Court under Section 528 of the B.N.S.S. to quash the case on the basis of the compromise.

Accordingly, this Criminal Original Petition stands allowed, and the proceedings in C.C.No.2033 of 2022 on the file of the learned Judicial Magistrate No.I, Tirunelveli shall stand quashed as against these petitioners/A2 to A4 alone. The joint compromise memo shall form part and parcel of this order. Consequently, the connected Criminal Miscellaneous Petition is closed.
