ORDER : The Court made the following order :- The petitioner /Accused, apprehending arrest at the hands of the respondent police for the alleged offence punishable under Sections 406 and 420 of IPC in Crime No.273 of 2023 on the file of the respondent police, seeks anticipatory bail. 1/3
2. The case of the prosecution is that the defacto complainant lodged a complaint stating that the first accused/petitioner made a paper publication inviting the abroad job aspirants for the purpose of arrangement of jobs in abroad. On the basis of the said advertisement and believing the words of the petitioner, the defacto complainant transferred money to her account on various dates. Totally Rs.1,40,000/- was transferred. Later, she defaulted. The defacto complainant approached the petitioner but he did not respond properly.
3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and she has been falsely implicated in this case. He further submitted that this Court has granted anticipatory bail to the co-accused in Crl.O.P(MD).No.12887 of 2023 on 21.07.2023.
4. The learned Additional Government Pleader appearing for the respondent police submitted that the petitioner has approached the defacto complainant on the false promise of securing job in abroad and the entire amount transferred to the petitioner's account. He further submitted that only a bald allegation has been made against the second accused, on that ground only, anticipatory bail was granted to the second accused by this Court.
5. Considering the fact that there is a specific allegation has been made against the petitioner and the bail granted to the co-accused cannot be extended to this 2/3
