PRAYER:Writ Petition is filed under Article 226 of the Constitution of India, to issue a writ of Mandamus, directing the respondents to disburse the petitioner's difference amount of Salary, Gratuity, Surrender Leave, Provident Fund, Pensions Arrears and to revise Pensions on the basis of 12(3) Settlement dated 24.08.2022, along with 6% interest.

ORDER

The instant writ petition has been filed by a Special Grade Driver of the respondent transport corporation, who voluntarily retired from service on 15.04.2020.

2.According to the learned Counsel appearing for the writ petitioner, after his retirement the management and the trade union have entered into a settlement under Section 12(3) of the Industrial Disputes Act, on 24.08.2022 w.e.f.01.09.2019. Since the petitioner is also eligible for the said benefits, he had sent a representation on 18.06.2024. However, there is no response, the present writ petition has been filed.

3.Considering the above said facts, the respondents transport corporation herein are directed to confer the eligible benefits upon the writ petitioner along with 6% interest from the due date till the date of realisation within a period of twelve weeks from the date of receipt of a copy of this order. 2/4

4.With the above said observations, this writ petition stands disposed of. No costs.
