PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus to direct the respondents to sub divide, demarcate and issue separate patta for the land in S.No.414/12 in Kovilur Village Kandharvakottai Taluk, Pudukottai District to the extent of 179.48 Sq.Ft out of the total extent of 538.46 Sq.ft by considering petitioner's representation dated 25.03.2025 and 26.05.2025 within a time to be stipulated by this Court. 1/4

ORDER

The petitioner seeks subdivision, demarcation and issuance of separate patta for the land in S.No.414/12.

2. Learned counsel for the petitioner relies upon sale deed dated 20.01.2025 and contends that such sale deed was executed in favour of the petitioner by one A.Rasul Khan. Learned counsel for the petitioner also points out that a joint patta was issued under patta No.1484 in the name of Rasul Khan, Subramanian, Rangadurai and Senthilnathan.

3. Learned Government Advocate submits that an inquiry would be conducted by issuing notice to all the pattadhars under patta No.1484. Upon conclusion of such inquiry, he submits that a speaking order would be issued in relation to the petitioner's request for subdivision, demarcation and separate patta.

In view of the submissions of learned Government Advocate that an inquiry would be conducted by issuing notice to all the pattadhars, including the 5th respondent herein, it is not necessary to issue notice in this writ petition to the 5th respondent. Instead, the writ petition is disposed of by directing the 3rd respondent to conduct an inquiry in relation to the petitioner's request for subdivision after issuing notice to all the pattadhars under patta No.1484. A speaking order shall be issued upon conclusion of such inquiry within three months from the date of receipt of a copy of this order.
