ORDER : The Court made the following order :- The petitioner/accused No.4, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 8(c) and 20(b)(ii)(B) of NDPS Act, 1985 in Cr.No.386 of 2021, seeks anticipatory bail.

2.The case of the prosecution is that on receiving secret information, on 10.10.2021 at about 13.30 hours, the police party reached Olavilai junction, wherein they found that the accused were in possession of ganja weighing 1.300 grams. Hence, the present complaint.

3. The learned counsel for the petitioner would submit that the petitioner is innocent and a false case has been foisted against him. Hence, he seeks anticipatory bail to the petitioner. https://hcservices.ecourts.gov.in/hcservices/

4.The learned Additional Public Prosecutor appearing for the State would submit that the petitioner is A.4 in this case and all the other accused 1 to 3 were arrested and this petitioner was also present at the place of occurrence and on seeing the police party, he fled away from the spot. He would further state that the investigation in this case is pending.

5. Considering the seriousness and the gravity of the offences and that the investigation is pending as stated by the learned Additional Public Prosecutor, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
