(R5 is impleaded vide order of this Court dated in W.M.P(MD) No.17485 of 2025 in W.P(MD) No.20393 of 2025) PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the second respondent to Mutate the revenue records, by removing the name of "Bhoomithaniyakkam" which was erroneously entered during UDR, and to enter the names of the petitioner and her sons, Balavignesh and Balavishnu, as legal heirs of Late Balakrishna Reddiar, in respect of 4 acres and 40 cents in S.No.1372/1A1, situated at Veppilankulam Village, Radhapuram Taluk, Tirunelveli District by considering the petitioner's representation dated 21.02.2025.

O R D E R

This Writ Petition has been filed seeking a direction to the second respondent to Mutate the revenue records, by removing the name of "Bhoomithaniyakkam" which was erroneously entered during UDR, in respect of 4 acres and 40 cents in S.No.1372/1A1, situated at Veppilankulam Village, Radhapuram Taluk, Tirunelveli District by considering the petitioner's representation dated 21.02.2025. 2/6

According to the petitioner, her husband namely Balakrishna Reddiar was allotted 10 Acres and 41 cents in S.No.1372/1 and subsequently out of the said extent, 6 Acres and 1 cent was declared/acquired as surplus under the provisions of Tamil Nadu Land Ceiling Act. The said surplus land was given a separate sub division No.1372/1A2A and the remaining extent was in the possession of petitioner's husband and was enjoyed by him and the said extent of 4.40 acres was wrongly mutated in favour of the Boomithaniyakkam during UDR. The petitioner has sent a representation on 21.02.2025 seeking deletion of entry in favour of Boomithaniyakkam in respect of said 4.40 acres from the revenue records and to include the name of the petitioner's husband or the names of his legal heirs. Since the same has not been considered, she has come before this Court.

3. The learned Additional Government Pleader, who takes notice for the respondents submits that the representation of the petitioner shall be considered by the competent authority namely the District Revenue Officer, Tirunelveli, and he is not made as a party to this Writ Petition. 3/6

In view of the same, without expressing any opinion on the merits of the matter, the second respondent is directed to forward the petitioner's representation dated 21.02.2025 to the competent authority, namely the District Revenue Officer, Tirunelveli District, within a period of two weeks from the date of receipt of a copy of this order. The said authority shall consider the representation after issuing notice to the petitioner and the fifth respondent, who represents Boomithaniyakkam and pass final orders on its own merits in accordance with law within a period of twelve weeks thereafter.

5. Accordingly, this Writ Petition stands disposed of. There shall be no order as to costs.
