For Respondent : Mr.RMS.Sethuraman, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C. PRAYER :-For Anticipatory Bail in Crime No.109 of 2021 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner/Accused, who apprehends arrest at the hands of the respondent police for the offences punishable under Section 399 IPC, in Crime No. 109 of 2018, seeks anticipatory bail. 2.The case of the prosecution is that on 22.05.2018 at about 06.30 am, the petitioner and the other accused have jointly prepared to commit dacoity. Hence the complaint.

3.The learned counsel for the petitioner would submit that the petitioner is innocent and he has not committed any offence as alleged by the prosecution.

4.The learned Additional Public Prosecutor appearing for the respondent would submit that charge sheet has already been filed before the concerned Court and the same has been taken cognizance in PRC.No.21 of 2021 and the learned Magistrate has ordered for issuance of summons on 25.11.2021.

CRL OP(MD). No.17459 of 2021 5.Since summons were ordered to be issued to the accused, the question of granting anticipatory bail does not arise. Hence, this Criminal Original Petition is dismissed.
