Mr.S.Anwar Sameem, learned counsel for sole writ petitioner, Mr.M.Lingadurai, learned Special Government Pleader on behalf of official respondents and Mr.M.R.S.Prabhu, learned counsel for private respondent (fifth respondent) are before this Court.

2. Learned counsel on record for writ petitioner submits that writ petitioner is no more, there are no instructions from legal heirs to pursue the matter and therefore, captioned writ petition can be closed.

3. Though obvious it is made clear that this Court has not expressed any view or opinion on the merits of the matter in this order. In other words, all questions raised in the captioned writ petition are left open, if it is agitated in the days to come in any other form.

4. Captioned writ petition is disposed of as closed recording the stated position qua late writ petitioner. Consequently, connected captioned writ miscellaneous petition is also disposed of as closed. There shall be no order as to costs.
