Order : This petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.SRIDHARAN, Advocate for the petitioner and of M/S.R.SURESH KUMAR, Government Advocate (Crl.side) on behalf of the Respondent, the court made the following order:- This petition has been filed to modify the condition imposed upon the peetitioner vide order dated 19.06.2023 in Crl.O.P.(MD).No.12386 of 2023 as to 1/3

deposit a sum of Rs.40,000/- to the credit of the crime number.

2. The learned counsel for the petitioner submitted that since the petitioner is aged about 80 years, he is not in position to deposit the above said amount.

3. Such sort of contention made by the petitioner cannot be accepted. By considering all the factors only, the above said order has been passed. I find no reason to modify the above said condition.
