ORDER

Heard the learned counsel on either side.

2. The petitioner wants this Court to dissolve the second respondent and revive the erstwhile society. During the pendency of this writ petition, the first respondent had taken the stand that since the erstwhile society had already been deleted from the register as a defunct society, the petitioner has to move the Government by filing an appeal under Section 44(5) of the Tamil Nadu Societies Registration Act, 1975. It is for the petitioner to avail such remedy. Granting such liberty, the writ petition is disposed of. No costs. Consequently, connected miscellaneous petition is closed.
