ORDER

This Criminal Original Petition has been filed seeking a direction to direct the first respondent to pass appropriate order to transfer the Investigation of the Cr.No. 828 of 2015 dated 23.08.2015 on the file of the 2nd respondent to some other investigation officer and further direct them to complete the investigation

It is also seen that the petitioner approached this Court in Crl.O.P(MD) No.15668 of 2017 to expedite the investigation in Crime No.828 of 2015 and this Court by an order dated 21.11.2017, directed the second respondent to complete the investigation and fine the final report before the concerned Court within a period of two weeks from the date of receipt of a copy of this order. Even today, the second respondent did not complete the investigation and filed final report . Therefore the learned counsel for the petitioner seeks transfer of investigation from second respondent to any other investigating Officer.

3. The learned Government Advocate(Crl.Side) would submit that the second respondent is yet to complete the investigation and since the crime has been registered for the offences under Sections 417 and 506(i) of IPC.

Considering the above facts and circumstances of the case the second respondent is directed to complete the investigation and file a final report before the concerned Court within a period of four weeks from the date of receipt of a copy of this order. Further, the first respondent is directed to monitor the investigation done by the second respondent and ensure that the second respondent shall complete the investigation within the time stipulated by this Court.

With the above observation and direction, the Criminal Original Petition stands disposed of.
