ORDER : The Court made the following order :- The petitioners /Accused, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 6(4) of Tamil Nadu Scheduled Commodities (Regulation of Distribution by Call System)Order, 1982, r/w Section 7 (1)(a)(ii) of the Essential Commodities Act, 1955 in crime No.120 of 2024 on the file of 1/3
the respondent police, seek anticipatory bail. 2.The case of the prosecution is that one Udaiyar, who is arrayed as A5, was found in possession of 430 bags of PDS rice. Hence, the de-facto complainant lodged a complaint before the respondent police.
3. The learned counsel for the petitioners would submit that the petitioners are innocents and they have not committed the offence as alleged by the prosecution. Hence, he prays for grant of anticipatory bail to the petitioners. 4.The learned Government Advocate(Crl.sdie),on instructions, would submit that these persons are involved in going streetwise and collecting PDS rice. 5.In view of the huge quantity collected, I am of the view that this is not a fit case for grant of anticipatory bail and the investigation is at the nascent stage and all the facts relating to the manner in which these PDS rice are being collected have to be thoroughly investigated and therefore, I am not inclined to grant anticipatory bail to the petitioners.
