ORDER

This Contempt Petition has been filed to punish the respondent for his willful disobedience of the order, dated 11.01.2023, in W.P.(MD)No. 666 of 2023.

2. This Court by an order, dated 11.01.2023, issued a direction to the contemnor/respondent to withhold a sum of Rs.2,55,000/- from the pensionary and terminal benefits of the petitioner and pay the balance amount of the pensionary and terminal benefits to him. Subsequently, enquiry was conducted and on enquiry, it was found that more than Rs.13 lakhs was misappropriated by the petitioner. Thereby, another impugned order was passed by the respondent on 13.10.2023. Challenging the same, the petitioner filed another Writ Petition in WP(MD)No.26585 of 2023 before this Court.

3. Considering the facts and circumstances of the case and also considering the fact that though without considering the subsequent misappropriation of Rs.13 lakhs, this Court passed the order dated 11.01.2023, challenging the impugned order dated 13.10.2023, the petitioner filed another WP(MD)No.26585 of 2023, this contempt petitions is closed.
