ORDER

The petitioner has made a request to the respondent police to permit the petitioner's organisation to conduct hunger strike and the respondent police vide impugned order have rejected the same. 2.The learned counsel for the petitioner submits that it is only a democratic protest, however the respondent police have rejected their request.

3.The learned Additional Public Prosecutor appearing for the respondent police submits that the proposed place is traffic prone area and it also falls on a working day. Therefore, considering all these, they have not granted permission that it may cause inconvenience to the public and may also lead to law and order issue. 2/5

4.This court considered the rival submissions made. 5.The petitioner is entitled to conduct the protest. At the same time, the police are having responsibilities towards maintaining law and order. Therefore, the respondent police shall identify an alternate place for conducting the protest as proposed in the petition in consultation with the petitioner and shall consider the request of the petitioner positively.
