PRAYER :- For Bail in Crime No.4 of 2023 on the file of the respondent police. ORDER : The Court made the following order :- The petitioner/Accused herein, who was arrested on 15.07.2023 for the alleged offence under Sections 120(b), 147, 148, 294(b) and 307 of IPC, in Crime No.4 of 2023, on the file of the respondent police, seeks bail. 1/4

The case of the prosecution is that on 03.01.2023, at about 09.30 p.m, while the defacto complainant's brother, namely, Ramesh, went to his house, the petitioner picked up the quarrel with him and also took away the bike key and also threatened him. Thereafter, on 04.01.2023, at about 6.30 p.m, the petitioner along with other accused went the defacto complainant's quarry and picked up a quarrel with the defacto complainant's father and also attacked him. Thereafter, the defacto complainant went to the spot, wherein he found his father with grievous injuries. Hence the complaint.
3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. He further submitted that this petition has been filed mainly on the ground that this Court has granted bail and the anticipatory bail to the co-accused.
4. The learned Additional Public Prosecutor (Crl.Side) submitted that the issue is between the two groups of people over business rivalry. The injured has been discharged from the hospital. He further submitted that several cases are pending against this petitioner.
5. A perusal of CD file shows that the dispute between the two groups of people arose over running the quarry. This Court has granted bail and anticipatory bail to the co-accused.

6.Considering the facts and circumstances of the case, the grant of bail to the coaccused and also considering the period of incarceration undergone by the petitioner, this Court is inclined to grant bail to the petitioner with stringent conditions.
7. Accordingly, this Criminal Original Petition is allowed and the petitioner is ordered to be released on bail, on executing a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Thirumayam, and on further condition that the petitioner shall stay at Dindigul and report before the learned Judicial Magistrate No.I, Dindigul daily at 10.30 a.m. until further orders. The petitioner is directed to produce his Passport before the learned Judicial Magistrate No.I, Dindigul and if any condition is imposed upon him by the learned Judicial Magistrate, the petitioner shall comply the same, if any failure is noticed, the bail granted by this Court shall stand cancelled automatically without any reference to the Court. sd/- 17/08/2023 / TRUE COPY / 17/08/2023 Sub-Assistant Registrar (C.S.)
