COMMON ORDER The writ petition in WP.CRL.(MD)No.686 of 2025 has been filed by one Mr.V.Ratheesh Kannan seeking a direction to the second respondent to provide Police protection for conducting the temple festival from 28.07.2025 to 30.07.2025 in Arulmigu Easikki Amman Temple situated in S.No.233/1 and 245/2, Udankudi Village, Thoothukudi District. 2.The writ petition in WP.CRL.(MD)No.691 of 2025 has been filed by one Mr.G.Siva seeking a direction to the respondents 1 to 4 to prevent Mr.V.Ratheesh Kannan/fifth respondent and his men from illegally trespassing into his land in S.No.247/1C and S.No.233/1 situated at Chettiapathu Village, Udankudi, Tiruchendure Taluk, Tuticorin District under the guise of Easikki Amman Temple festival.
3.When the matters are taken up for hearing, the learned counsel appearing for the petitioner/Mr.V.Ratheesh 4/9
Kannan submits that the temple festival is over and nothing survives for further adjudication. The learned Additional Public Prosecutor appearing for the Police Officials also submits that the request of the said Mr.V.Ratheesh Kannan has been rejected.
4.The learned counsel appearing for the petitioner/Mr.G.Siva submits that the land in S.No.247/1C and S.No.233/1 situated at Chettiapathu Village, Udankudi, Tiruchendure Taluk, Tuticorin District is belonging to one Janagiammal, who is the grandmother of the petitioner/ Mr.G.Siva. He further submits that the temple is not situated in S.No.247/1C and S.No.233/1, however, the fifth respondent/Mr.V.Ratheesh Kannan under the guise of temple festival has encroached upon the property.
5.It is reported that there is a civil dispute between the parties and a suit in O.S.No.65 of 2025 is pending on the file 5/9
of the Sub Court, Tiruchendur and O.S.No.88 of 2025 pending on the file of the learned II Additional District Judge, Thoothukudi. Therefore, according to the petitioner/ Mr.G.Siva, the fifth respondent/Mr.V.Ratheesh Kannan is trespassing into the property in S.No.247/1C and S.No. 233/1.
6.The learned Special Government Pleader appearing for the Revenue Officials, based on the report of the Tahsildar, submits that the land in S.No.247/1C and S.No.233/1 stands in the name of the petitioner/Mr.G.Siva.
7.This Court has considered the submissions made on either side and perused the available records. 8.The petitioner in WP.CRL.(MD)No.686 of 2025 has made a request to conduct temple festival in S.No.233/1 and 245/2. However, the same is disputed by the petitioner in WP.CRL.(MD)No.691 of 2025 that the land in S.No.247/1C 6/9
and S.No.233/1 is belonging to him. It is the case of the petitioner in WP.CRL.(MD)No.691 of 2025 that by projecting temple festival, the petitioner in WP.CRL.(MD)No.686 of 2025 is attempting to encroach upon his land.
9.Since the prayer sought for in WP.CRL.(MD)No.686 of 2025 has become infructuous, the said writ petition is dismissed as infructuous. Since it is reported that the land in S.No.247/1C and S.No.233/1 stands in the name of the petitioner/Mr.G.Siva, the writ petition is disposed of with a direction to the petitioner in WP.CRL.(MD)No.686 of 2025 to workout his remedy before the civil Court in the pending suits. No costs. Consequently, connected miscellaneous petitions are closed.
