PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Certiorarified Mandamus, calling for the records relating to the impugned order dated 06.08.2023 passed by the second respondent and quash the same and consequently directing the respondents to grant permission and adequate police protection for conducting "Orchestra" on 11.08.2023 and Palsuvai Kalai Nigalchi (Adal Padal) on 12.08.2023 on the eve of Arulmigu Sri Perumalsamy Temple, situated at Adaiyal Village, Thattarmadam, Thoothukudi District.

This Writ Petition is filed challenging the orders passed by the second respondent rejecting the permission to the petitioner to conduct Orchestra on 11.08.2023 and Palsuvai Kalai Nigalchi (Adal Padal) on 12.08.2023 on the eve of Arulmigu Sri Perumalsamy Temple, situated at Adaiyal Village, Thattarmadam, Thoothukudi District.

2. Heard the learned counsel for the petitioner.

3. During the course of submissions, learned Government Advocate (Criminal Side) has informed the Court that if the petitioner approaches afresh, the respondent Police have no objection for giving permission for conducting of Adal Padal Programme by imposing usual conditions.

4. Accordingly, this Writ Petition is disposed of, directing the petitioner to approach the respondent Police and file an application afresh, on which, the respondent Police are directed to consider the same and grant permission to conduct Orchestra and Adal Padal Programme as per the guidelines of the Police vide proceedings in Rc.007301/Genl.I (1)/2019, dated 2/4

09.04.2019, as required to date, time and place of conducting the programmes. No costs.
