PRAYER:- Petition - filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus directing the respondent to issue in respect of the property comprised in T.S.No.57, Ward No.D, Block No.20 of an extent of 0.33.0 Hectares situated at Kodaikkanal Town and Taluk, Dindigul District by considering the proceedings of the 2nd respondent in Na.Ka.No.08/2017/A1 dated 14.02.2018 and by considering representation of the petitioner dated 31.09.2021 within the time stipulated by this Court. 1/4

ORDER

This writ petition has been filed for issuance of writ of mandamus directing the respondents to deal with the representation made by the petitioner, wherein the petitioner is seeking for patta with respect to the subject property.

2. The third respondent has filed a counter affidavit and it is stated in the counter that the representation made by the petitioner was considered and through proceedings dated 26.10.2021, the request made by the petitioner was also rejected by citing G.O.(Ms)No.1168, Revenue Department, dated 25.07.1989.

3. The learned counsel appearing for the petitioner submitted that the petitioner has not received any such proceedings.

4. In the light of the specific stand taken by the third respondent, the relief as sought for by the petitioner cannot be granted by this Court. However, there shall be a direction to the third respondent to despatch a copy of the 2/4

proceedings in Na.Ka.No.2403/2021/A2 dated 26.10.2021 to the petitioner, within a period of two weeks from the date of receipt of a copy of this order. It is left open to the petitioner to work out his remedy in the manner known to law.

5. This writ petition is disposed of. No costs. Consequently, connected miscellaneous petition is closed.
