2024-08-27Honourable Mr Justice D.Bharatha Chakravarthy3 pages

BEFORE THE MADURAI BENCH OF MADRAS HIGH COURT ( Criminal Jurisdiction ) Date : 27/08/2024 PRESENT The Hon`ble Mr.Justice D.BHARATHA CHAKRAVARTHY Rathinaraja @ Paul Rathinaraja ... petitioner/Accused 3 Vs.

State through The Inspector of Police, Manur Police Station, Tirunelveli District.

(In Crime No.152 of 2024) ... Respondent/Complainant For petitioner : M/s.R.Shalini Priyanka Advocate.

For Respondent :Mr.R.M.Anbunithi, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec. 482 BNSS PRAYER :- For Anticipatory bail in Crime No.152 of 2024 on the file of the respondent police.

ORDER : The Court made the following order :- 1/3

The petitioner /Accused, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 467, 468, 471, 472 and 420 IPC, in Crime No.152 of 2024 on the file of the respondent police, seeks anticipatory bail. 2.The case of the prosecution is that the accused persons conspired together with the other accused and created forged patta by creating Government seal and by forging the signatures of the Tahsildar. Hence, the complaint was lodged.

3. The learned counsel for the petitioner would submit that the petitioner is an innocent and he has been falsely implicated in this case. Hence, he prays for grant of anticipatory bail to the petitioner.

4.Heard the learned Additional Public Prosecutor appearing for the State. 5.Considering the nature of allegations in the case that when the land belongs to Adi Dravidar and Tribal Welfare, all the accused conspired together and promised the beneficiaries of patta and instead of getting Patta from the Government, they gave forged patta based on which, the beneficiary has also constructed house on the said Government land, this is not a FIR case. The learned 2/3

counsel for the petitioner would rely upon the order of the accused No.1 being enlarged on anticipatory bail. It may be so, however, in this case when specific role has been assigned to the petitioner that he collected money at least from one beneficiary by promising patta, this is not a fit case for enlarging the petitioner on anticipatory bail. Hence, this Criminal Original Petition is dismissed. sd/- 27/08/2024 / TRUE COPY / /09/2024 Sub-Assistant Registrar ( C.S. I / II / III / IV ) Madurai Bench of Madras High Court, Madurai - 625 023.
