ORDER
The relief sought for the present writ petition is to direct the respondent to select and appoint the writ petitioner to the post of Secondary Grade Teacher in the inter-caste marriage priority. The grievance of the writ petitioner is that she is fully qualified for appointment to the post of Secondary Grade Teacher and she is eligible to avail the priority quota on inter-caste marriage. She registered her name in the Employment Exchange. However, her name was not sponsored. Thus, the petitioner is constrained to file the present writ petition.
2.The counter filed by the respondents reveals that the petitioner has registered her name in the Employment Exchange on 17.11.2004 under the priority category of inter-caste marriage. However, the Teachers Recruitment Board has taken measures to recruit the Teachers through Employment Exchange seniority, the name of the petitioner was not sponsored by the Employment Exchange. Since her name was not sponsored, the Board could not call for the certificate verification and she was not considered for further process of selection. Now the process of selection is being conducted through Teacher Recruitment Board and by adopting State wide seniority list. A mere registration of the name in the Employment Exchange would not confer any right to claim appointment. https://hcservices.ecourts.gov.in/hcservices/ 1/2
W.P.(MD) No.1141 of 2015 3.All appointments are made strictly in accordance with the recruitment rules in force. Equal opportunity in public employment is constitutional mandate. Thus, all candidates aspiring to secure public employment must be provided with an opportunity to participate in the open competitive process.
Mere registration of the name in the Employment Exchange would not confer any right on the candidate to claim appointment. Thus, the very claim set out in the writ petition deserves no merit consideration and the petitioner is at liberty to participate in the process of selection, if any recruitment notification is issued by the competent Authorities. 4.With these observations, this writ petition stands dismissed. No costs.
