PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Certiorarified Mandamus, calling for the records pertaining to the impugned order passed by the second respondent through his proceedings in C.No.08/INS/Proceeding/2023, dated 02.08.2023 and quash the same as illegal, consequently, directing the respondents to grant permission and necessary protection to conduct the "Innisai Kacheri and Adal Padal" programme on 10.08.2023 at 07.00 p.m to 10.00 p.m. in connection with "Thiru Vizha" of Arulmigu Sri Vadakku Vasal Selvi Amman Thirukovil at Vadivammanpatti Village, Kottaikarungulam, Tirunelveli District. This Writ Petition is filed seeking to set aside the orders dated 02.08.2023, vide proceedings in C.No.08/INS/Proceeding/2023 of the second respondent Police, refusing to grant permission to the petitioner for conducting of the Adal Padal Programme at Arulmigu Sri Vadakku Vasal Selvi Amman Thirukovil at Vadivammanpatti Village, Kottaikarungulam, Tirunelveli District.
2. It is submitted by learned counsel for the petitioner that they are prepared to give undertaking to follow the conditions if any to be imposed by the respondent Police scrupulously and therefore, sought for suitable directions.
3. Learned Government Advocate (Criminal Side) on the other hand, submits that, last year, when this kind of programme was conducted, the petitioner did not sought for any permission and conducted the programme until 11.30 p.m., on account of which, the Police have registered a case against the petitioner in Crime No.196 of 2022 for the offences under Sections 143 and 188 of I.P.C.
4. Considering the submissions made by both sides, since the petitioner is coming forward seeking for permission and agreeing to abide by 2/4
the conditions to be imposed by the respondent Police, this Writ Petition is disposed of, directing the petitioner to approach the respondent Police, afresh, on which, the respondent Police are directed to consider the request of the petitioner and to grant permission as per the guidelines issued vide proceedings in Rc.007301/Genl.I (1)/2019, dated 09.04.2019, in respect of the place, time and other aspects of the programme.
