PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a writ of mandamus directing the respondents 1 to 4 to remove the encroachments made by the fifth respondent in the Government land situated in Survey No.1325/2, East Ayakudi Village, Palani Taluk, Dindigul District, based on the petitioner's representation dated 25.10.2018. [Order of the Court was made by The Hon'ble ACTING CHIEF JUSTICE] Prayer in this writ petition is to direct the respondents 1 to 4 to remove the encroachments made by the fifth respondent in the Government land in Survey No.1325/2 of East Ayakudi Village, Palani Taluk, Dindigul District, based on the petitioner's representation dated 25.10.2018.
2. According to the petitioner, the subject land is a Government land, which is used by the village people for the purpose of conducting public meetings and other purposes. However, the fifth respondent has encroached upon the subject land. Seeking to remove the encroachments made by the fifth respondent, the petitioner has given a representation dated 25.10.2018 to the respondents 1 to 4. However, no action was taken based on his representation. Hence, this writ petition.
3. Learned Government Pleader appearing for the respondents 1 to 4, on instructions, would submit that necessary action will be taken by the authority concerned for removal of encroachments in the subject land based on the petitioner's representation.
4. Taking into consideration the facts and circumstances of the case, we direct the fourth respondent to take necessary action for removal of encroachments in the subject land, in accordance with law, after providing due opportunity to the parties concerned. Such an exercise shall be completed within a period of eight weeks from the date of receipt of a copy of this order.
5. With the above direction, this writ petition is disposed of. No costs.
