PRAYER : This Criminal Appeal has been filed under Section 14(A)2 of SC/ST (PoA) Act, 1989 amended by Act 1/2016 to call for the records and set aside the order of the learned Sessions Judge, Special Court for Exclusive Trial of cases under SC/ST (PoA) Act, Dindigul dated 15.04.2025 in Crl.M.P.(MD)No.1682 of 2024 in Special S.C.No.2 of 2023 and direct the learned Sessions Judge, Special Court for Exclusive Trial of cases under SC/ST (PoA) Act, Dindigul to split up the case as against the petitioner from the above case in accordance with law within the time stipulated by this Court.

Side) J U D G E M E N T This appeal has been filed challenging the order of the learned Sessions Judge, Special Court for Exclusive Trial of cases under SC/ST (PoA) Act, Dindigul dated 15.04.2025 in Crl.M.P.(MD)No.1682 of 2024 in Special S.C.No.2 of 2023.

2. Mr.K.Gnanasekaran, learned Government Advocate (Criminal Side) takes notice for the respondent.

The appellant is the 13th accused who has filed a petition before the learned Sessions Judge, Special Court for Exclusive Trial of cases under SC/ST (PoA) Act, Dindigul praying to split up his case and conduct trial and finish it as early as possible. The learned Sessions Judge has dismissed the same because of the fact that there are several accused and some of the accused have to be produced on PT warrant.

4. The learned counsel for the appellant submitted that the appellant has been falsely implicated in this case and he is studying in 2/5

3rd year L.L.B. Course and due to the pendency of the case, his studies are getting affected.

5. From the Report submitted by the learned Sessions Judge, Special Court for exclusive trial of cases under SC/ST (PoA) Act, Dindigul, it appears that the case has been posted to 05.08.2025 in order to decide to splitting the case against A5 and A15 against whom NBW is pending for a long time.

As the learned Sessions Judge has taken note of the fact that the trial could not progress in view of the long pending warrant against A5 and A15, I feel no separate split of the appellant / 13th accused in this case needs to be done. In case NBW against A5 and A15 is not executed before 05.08.2025, the learned Sessions Judge shall take a call to pass orders for splitting the case against A5 and A15 and proceed with the case by furnishing copies to the accused who have been present all along.
