ORDER

The petitioner herein seeks a direction to the respondent to sub divide and issue separate patta in respect of 13 acres and 75 cents purchased by him in Survey Nos. 757A, 759A and 760B of Seevalaperi Village, Palayamkottai Taluk, Tirunelveli District by considering his online application dated 02.05.2024.

2. Heard the learned counsel appearing for the petitioner and Mr.S.Jeya Priya, learned Government Advocate who takes notice for the respondent.

3. By consent of both the parties, the writ petition is taken up for final disposal at the stage of admission itself.

4. According to the petitioner, his father pream purchased 13 acres 75 cents in an open auction conducted by the Authorized Officer, Canara Bank, Kanyakumari District under a Sale Certificate dated 19.05.2022. Subsequently, the petitioner's father executed a Settlement Deed in favour 2/6

of the petitioner on 29.11.2024. On the basis of the above mentioned documents, the petitioner has submitted an online application on 02.05.2025, seeking issuance of separate patta and the same has not been considered. Hence, the petitioner has come before this Court.

5. The learned Government Advocate who takes notice for the respondent would submit that the Patta for the subject property stands in the name of the petitioner's father Pream and 12 other persons. Therefore, the petitioner request has not been considered.

In view of the same without expressing any opinion on the merits of the matter, the respondent is directed to consider the online application of the petitioner dated 02.05.2025 and pass final orders on its own merits and in accordance with law, after issuing notice to the petitioner, co-pattadhars and other interested parties within a period of twelve (12) weeks from the date of receipt of a copy of this order. 3/6

7. The writ petition is disposed of with the above observations. No costs.
