Prayer: Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Certiorari calling for the records relating to the proceedings dated 29.06.2015 in Na.Ka.No.A3/1283/2015 of the first respondent in so far as conducting fresh auction in respect of the fishery rights in Pillayarendal Kanmai, Chinnavengavayal Village, Sakottai Panchayat Union and quash the same.

O R D E R

This writ petition is filed as against the auction notice issued by the first respondent for the fishery rights in Pillayarendal Kanmai, Chinnavengavayal Village, Sakottai Panchayat Union, Sivagangai District.

2. The petitioner has filed this writ petition claiming that he has obtained the fishery lease right for the years 2014-15 and 2015-16 and even before his lease period is over, the respondents have attempted to put on a further auction.

3. The learned Special Government Pleader appearing for the respondents 1 and 2 has produced the written instructions received from 2/4

the Commissioner, Panchayat Union, Sakottai, wherein, it is stated that they have not conducted auction for fishery rights after the year 2015-16.

4. Even according to the petitioner, his lease period is for the years 2014-15 and 2015-16. Therefore, nothing survives for consideration in this petition and this writ petition is dismissed as infructuous. However, the respondents 1 and 2 are at liberty to conduct a fresh auction based on the Government Orders. No costs. Consequently, the connected Miscellaneous Petition is closed.
