PRAYER:Writ Petition is filed under Article 226 of the Constitution of India, to issue a writ of Mandamus, directing the respondent to consider and dispose petitioner's representation dated 15.02.2024, relating to regularization of service by including petitioner service from 06.01.1986 to 01.06.1990 working as daily wages driver in the light of G.O.Ms.No.408, Finance (Pension) Department, dated 25.08.2009.

ORDER

The instant writ petition has been filed by a retired daily wage driver of the respondent Corporation, seeking a mandamus for disposal of his representation, dated 15.02.2024 for regularisation. 2.The petitioner herein was originally appointed as an acting Driver in the Chennai Municipal Corporation on 06.01.1986 and according to the petitioner herein, he was made a permanent Driver w.e.f.01.06.1990. After completion of probation on 10.07.1992, the petitioner was transferred to Madurai Corporation and had attained superannuation on 03.06.2019. 3.According to the learned Counsel appearing for the writ petitioner, the services rendered by the petitioner as a temporary Driver between 1986 to 1990 have to be taken into consideration for the purposes of calculation of pension as contemplated under G.O.Ms.No.408, Finance(Pension), dated 25.08.2009. The petitioner has sent a representation to the respondent Corporation on 15.02.2024 and the same has also been acknowledged by the respondent. Since there is no response, the present writ petition has been filed. 2/4

4.Considering the above said facts, the respondent Corporation is directed to dispose of the representation of the writ petitioner within a period of eight weeks from the date of receipt of a copy of this order. 5.With the above said observations, this writ petition stands disposed of. No costs.
