For Respondent : Mr.RMS.Sethuraman, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory bail in Crime No.138 of 2021 on the file of the Respondent police.
ORDER : The Court made the following order :- The petitioners/Accused 1 & 2, who apprehend arrest at the hands of the respondent police for the offence punishable under Section 174(3) of Cr.P.C. @ 304(B) IPC in Crime No.138 of 2021, seek anticipatory bail.
2.The case of the prosecution is that the first accused and the deceased are husband and wife and due to demand of dowry, the deceased came to her parental home and stayed there for the past one month. On 24.08.2021 at about 10.00 hours, the deceased committed suicide by hanging in the ceiling. Hence, the complaint. https://hcservices.ecourts.gov.in/hcservices/
CRL OP(MD). No.17570 of 2021 3.The learned counsel appearing for the petitioners would submit that the petitioners are innocent and they have not committed any offence as alleged by the prosecution and due to personal vindictive a false case was foisted against them. Hence, he seek for grant of anticipatory bail.
4.The learned Additional Public Prosecutor appearing for the respondent would submit that as per Revenue Divisional Officer's report, the deceased committed suicide due to dowry problem. Further, he would submit that investigation is not yet completed. 5.Considering the seriousness and gravity of offences alleged and also submissions of the learned Additional Public Prosecutor that the report of the Revenue Divisional Officer reveals that dowry harassment was the reason for the suicide of the deceased and that the investigation is pending, this Court is not inclined to grant anticipatory bail to the petitioners, at the nascent stage of investigation.
