PRAYER:- Petition - filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus directing the 1st respondent to provide the entire compensation to petitioner under the Tamil Nadu Victim Compensation Scheme 2018 along with earlier interim compensation award passed by the 2nd respondent in VCP No.05 of 2018 by considering petitioner's representation dated 16.07.2021.

ORDER

This writ petition has been filed for issuance of writ of mandamus directing the first respondent to provide compensation to the petitioner under the Tamil Nadu Victim Compensation Scheme, 2018 by considering the representation made by the petitioner on 16.07.2021.

2. The case of the petitioner is that her husband was hacked to death and as a result, the petitioner along with her children were left in lurch. The petitioner applied for compensation under the Tamil Nadu Victim Compensation Scheme, 2018 before the second respondent. The second respondent, through an award dated 14.12.2018 directed the payment of interim compensation to the tune of Rs.1,50,000/-.

3. It is brought to the notice of this Court that the petitioner has been paid the interim compensation amount.

4. The claim of the petitioner is that the petitioner is entitled for the entire compensation amount under the Tamil Nadu Victim Compensation Scheme 2018, wherein the minimum compensation of Rs.5,00,000/- is payable and the maximum compensation can be paid upto Rs.10,00,000/- and the 2/4

petitioner made a representation in this regard before the first respondent on 16.07.2021. Since the same was not considered, the present writ petition has been filed before this Court.

5. Heard Mr.S.M.A.Jinnah, learned counsel for the petitioner and Mr.K.S.Selvaganesan, learned Additional Government Pleader for the respondents.

6. Taking into consideration the facts and circumstances of the case and the nature of the relief that has been sought for by the petitioner, there shall be a direction to the first respondent to consider the representation made by the petitioner on 16.07.2021 and deal with the same in the light of the Tamil Nadu Victim Compensation Scheme 2018 and convey the decision to the petitioner within a period of six weeks from the date of receipt of a copy of this order.
