Respondent/Complainant PRAYER :- This petition is filed under Section 439(1)(b) of Cr.P.C., to modify the one of the condition alone imposed the Petitioner deposit amount of Rs.50,000/ (Rupees Fifty Thousand) which is non refundable amount order in Crl.MP.(MD).No.3899 of 2022 passed by the Principal District and Sessions Judge, Thanjavur. ORDER

This petition has been filed to modify one of the condition alone imposed upon the Petitioner deposit amount of Rs.50,000/ (Rupees Fifty Thousand) which is non refundable amount order in Crl.MP.(MD).No.3899 of 2022 passed by the Principal Sessions Judge, Thanjavur.

2.Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Crl. Side) appearing for the respondent,Police.

3.Considering the submission made by both sides, the condition No. 1 imposed vide order dated, dated 22.08.2022 made in Cr.M.P.No.3899 of 2022, by the Principal Sessions Judge, Thanjavur is modified to the effect that "the petitioner is directed to pay a sum of Rs.25,000/- (Rupees Twenty Five Thousand only), which is non refundable to the credit of Education Department, by means of Demand Draft to be drawn in any one of the Nationalized Banks in favour of https://www.mhc.tn.gov.in/judis 1/2

CRL OP(MD). No.16529 of 2022 "The Chief Educational Officer, Thanjavur, (Development Fund) - Account No.05350100020509" of Bank of Baroda, Thanjavur, IFSC : BARB0TANJOR payable at Thanjavur and produce the original demand draft before the said office and obtain its proper acknowledgment receipt in his name with Crl.M.P.No." from the said office and produce the receipt, xerox copy of Demand Draft along with memo before jurisdictional Magistrate." The other conditions if any shall remain unaltered.
