ORDER : The Court made the following order :- The petitioners/Accused Nos.1 and 2, who were arrested on 28.07.2023 for the alleged offence under Sections 294(b) of IPC and 25(1) of Arms Act, in Crime No.55 of 2023, on the file of the respondent Police, seeks bail. 2.The case of the prosecution is that on 28.07.2023, when the SubInspector of Police along with Police officials on patrolling duty, the petitioner was found in illegal possession of two knife and along with one aruval and those things have been recovered by the respondent Police. Hence, the complaint. 3.The learned counsel for the petitioners would submit that the petitioners are innocent and they have been falsely implicated in this case. The petitioners are in custody from 28.07.2023. Hence, prays to release them on bail. 4.
The learned Additional Public Prosecutor appearing for the respondent would submit that the petitioners are not having any previous cases at their credit. 5.Considering the facts and circumstances of this case and considering the period of incarceration and no previous case is pending against the petitioners, this Court is inclined to grant bail to the petitioners with certain conditions. 6.Accordingly, this Criminal Original Petition is allowed and the petitioners are ordered to be released on bail, on executing a personal bond for a sum of Rs.
