PRAYER :-For Bail in Crime No.88 and 97 of 2021 on the file of the Respondent Police.

ORDER : The Court made the following common order :- The petitioner/Accused, who was arrested and remanded to judicial custody on 30.10.2021 for the offence punishable under Section 379 IPC r/w 21(4) of Mines and Minerals Act, 1957, in Crime No.88 and 97 of 2021, on the file respondent police, seeks bail. 2.The case of the prosecution is that the petitioner and the other accused illegally transported the river sand. Hence the complaint.

3.The learned counsel for the petitioner would submit that the petitioner is innocent and he has not committed any offence as alleged by the prosecution.

4.The learned Additional Public Prosecutor appearing for the respondent would submit that the petitioner transported the river sand illegally. He would further submit that the petitioner is having two previous cases similar in nature.

5.Considering the seriousness and gravity of the alleged offence and also the facts that the petitioner is having two previous cases for similar in nature and that when the petitioner remained absconding in respect of the Crime No.88 of 2021, he allegedly committed the present offence, this Court is not inclined to grant bail to the petitioner.
