Writ Petition filed under Article 226 of the Constitution of India, seeking for the issuance of a Writ of Mandamus, to direct the respondents 1, 3 and 4 to take action against the 5th respondent by conducting detailed enquiry by considering the petitioner's representation dated 12.07.2024 within time frame fixed by this Court.

ORDER

The petitioner has lodged a complaint before the Vigilance and Anti-Corruption Department as against the 5th respondent, who is working as Assistant Engineer in TANGEDCO alleging that by receiving money, she has intentionally removed the electricity wire, which was passing in front of the house of one Muthukumar and laid one electric pole in front of his house in favour of the said Muthukumar. Since there was no action, the petitioner has filed this writ petition.

2. Today, when this writ petition is taken up for hearing, the learned Additional Public Prosecutor submits that the complaint of the petitioner was already forwarded to the second respondent/the Chairman 2/4

cum Managing Director of TANGEDCO, for enquiry.

3. This Court considered the rival submissions and also perused the materials placed on record.

4. The materials placed by the petitioner are not sufficient to issue any mandamus directing the Vigilance and Anti-Corruption Department to conduct an enquiry. Therefore, this Writ Petition is dismissed.

5. Since the complaint of the petitioner has already been forwarded to the second respondent, the petitioner shall workout his remedy with the second respondent. The second respondent shall find out the truth and take appropriate action in accordance with law. 06.03.2025 ogy NCC : Yes / No.
