ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police 1/4

for the offence punishable under Sections 303(2) BNS (Sand Theft), in Crime No.480 of 2025 on the file of the respondent police, seeks anticipatory bail.

2. The prosecution of the prosecution is that based on the secret information that some miscreants have transported sand. Upon the information on 17.07.2025, the defacto complainant who is the Sub Inspector of Police along with deputed officials went near Union office and involved themselves in vehicle checkup. At that time, a vehicle bearing Registration No. TN 72 BU 4379 came towards them. The respondent police stopped the vehicle and found 2 units of river sand. During the enquiry, it reveals that the petitioner along with other accused persons illegally transported the river sand, without having any permit and license.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any offences as alleged by the prosecution. He further submitted that the petitioner is ready and willing to abide by any conditions which may be imposed by this Court. Hence, he seeks anticipatory bail to the petitioner.

4. The learned Government Advocate (Criminal Side) submitted that there are 2/4

22 previous cases pending against the petitioner and the investigation is at initial stage and if the petitioner is released on anticipatory bail, he may abscond. Hence, he opposed for grant of anticipatory bail to the petitioner.

5. Considering the facts and circumstances of the case and also the nature of the offence committed by the petitioner and there are 22 previous cases pending against the petitioner and the investigation is still pending, if the petitioner is released on anticipatory bail, he may tamper the witnesses and abscond. Hence, this Court is not inclined to grant anticipatory bail to the petitioner.
