PRAYER : Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus, to direct the respondents 1 to 3 to ensure that without any discrimination and first honour, by collecting tax from the petitioner and other people stands like him to participate in the temple Kumbaabishegam of Arulmigu Sri Poornakala, Sri Pushpakala, Udannamar, Sri Hariharaputtira Ayyanar, Sri Nondichamy, Sri Vinayagar, Sri Balamurugan, Sri Meenakshi, Udanaya Somasundarar, Sri Nagammal and Navakiragangal situated at Ward No.16, Thallakulam, Madurai North Taluk, Madurai Corporation, 1/5

ORDER
The present Writ Petition has been filed for the issuance of a Writ of Mandamus, to direct the respondents 1 to 3 to ensure that without any discrimination and first honour, by collecting tax from the petitioner and other people stands like him to participate in the temple Kumbabishegam and conduct the Kumbabishegam festival by allowing all the locality people to the above mentioned temple rituals starting from 08.08.2025 and then conduct the Kumbabishegam festival from 02.09.2025 to 04.09.2025 by considering the petitioner's representation, dated 02.07.2025. 2.The Learned Counsel appearing for the petitioner submitted the private respondents are discriminating against twenty families and are trying to conduct the Kumbabishegam. If the Kumbabishegam is conducted without any honour and by including all the people in the present village, the petitioner is not having any objection for conducting the Kumbabishegam. 2/5
3.On instructions from the Village Administrative Officer, the learned Special Government Pleader appearing for the respondents 1 to 3 submitted that the temple does not belong to any specific community and it is a temple where all people can worship and do poojas.
4.Therefore, this Court is directing the official respondents to conduct a peace committee meeting by calling all the claimants, including the petitioner and the respondents 4 to 8 and pass appropriate orders in accordance to law within a period of three days from the date of receipt of a copy of this order. The official respondents shall take the law and order situation into consideration and may impose conditions while conducting the Kumbabishegam. The parties are not allowed to take any first honour or any honour, since there is a ban to the same by the order passed by the Hon'ble Division Bench of this Court. If there is any honor from time immemorial and if there is any customary practice, the same shall be established before appropriate Civil Court. 5.With the above observations, this Writ Petition is disposed of. There shall be no order as to costs.
