ORDER
When the matter was taken up for hearing, an affidavit was filed by the respondent. The relevant portion of the same is extracted hereunder : "7. I submit that now after the above said directions issued by this Hon'ble Court on 29.11.2024, the petitioner and his wife had executed an indemnity bond in the presence of a notary public for receiving 35% of the total deposit amount which is calculated to be Rs.1,40,000/-. The respondent by means of the loan recovery proceedings had collected Rs.2,93,223/- while is now deposited in the savings banks accounts of the society maintained in the Madurai District Central Co-operative Bank in the A.c.No.253053191. So this respondent could make the payment of the 35% of the deposit amount to the petitioner and his wife as announced in the notification dated 20.02.2021 and in compliance with the directions of this Hon'ble Court.
8. I submit that the balance amount of Rs.2,60,000/- could not be disbursed within a short span of time, since the financial position of the society in dire straits. Any how I am taking hectic efforts to recover the loan dues from the borrowers and to reconstruct the assets of the society. So, the balance 2/4
amount of Rs.2,60,000/- shall be disbursed in 4 installments out of the recovery of the loan installments within a span of 6 months. It is prayed that this Hon'ble Court may also permit this respondent to disburse the balance amount as scheduled."
2. Taking into account the above stand taken by the respondent, the balance amount of Rs.2,60,000/- (Rupees Two Lakhs and Sixty Thousand only) shall be disbursed to the petitioner within a period of four months from the date of receipt of a copy of this order.
3. Accordingly, this Contempt Petition is disposed of with the above direction.
4. Post this matter under the caption "for reporting compliance" after four months.
