Order : This Criminal Miscellaneous petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.MANU TOM, Advocate for the petitioner and of MR.R.M.ANBUNITHI, Additional Public Prosecutor on behalf of the Respondent the Court made the following order:- This petition is filed to direct the Additional Judicial Magistrate, Sivagiri, Tenkasi District, to accept the valuation report by the approved valuer submitted along with the original documents of the title and surety memo and the release of the petitioner / A2 on bail in Crime No.309 of 2024 in compliance of the order passed by this Court dated 16.08.2024.
2. I have considered the averments made in the affidavit. It can be seen that the first property is in the name of the petitioner and is in Maradu Village, Ernakulam District, admeasuring 5.43 cents. Similarly, the second property is in the name of the wife of the petitioner. The same is also located in Maradu Village, Ernakulam District that is also administering for 3.53 cents. Considering the urban nature of the Ernakulam District itself and the nature of the location of the property and the valuation given by the approved valuer, I am of the view that the same can be accepted by the learnedAdditional Judicial Magistrate, Sivagiri, Tenkasi District. Therefore, the learned Additional Judicial Magistrate, Sivagiri, Tenkasi District, is directed to accept both the properties as surety for the condition which is originally 2/4
laid down by this Court.
3. Accordingly, this Petition disposed of.
